The access and the use of this e-commerce web site www.silvanosassetti.it (from now on referred to as the “Website”), as well as the purchase of products from the Seller, presuppose having read, knowing and accepting the following

General Conditions of Sale.

The present conditions discipline purchases made on this website, in accordance with the electronic trade regulation Parte III, Titolo III, Capo I, del Codice del Consumo, D.Lgs. n. 206/2005, modificato dal D.Lgs. n. 21/2014 e dal D.Lgs. n. 70/2003.

2. General Conditions of Sale

Object and pre- contracutal information

The following General Conditions of Sale regulate all sale contracts finalized between the Seller and the Client through the Website.

Every purchase is regulated by the General Conditions of Sale in the version published on the Website at the time of the order by the Client.

The Client is required to view the following General Conditions of Sale and accept them, in particular the pre-contractual information, before confirming the order.

The Website is commited to the sale to Consumers, if one or more sales to persons who do not qualify as Consumers occurs, these General Conditions of sale will apply, but with the following waivers:

the Buyer will not have the right to withdraw from the purchase as in art. 10 in the present Conditions of Sale
the Buyer will not benefit of the guarantee on the products as in art.8 of the present Conditions
the Buyer will not benefit of all the legal safeguards that protect the Consumer and are guaranteed by law.

When transmitting an order, the Customer accepts that the confirmation of the information about the order and these Terms and Conditions of Sale are sent via e-mail to the address stated when signing in on the Site, or during the purchasing process.

In order to purchase through the Site, the Customer must have the legal age (18 years).

Any costs for the Internet connection to the Site, including the telephone, are the sole responsibility of the customer according to the rates applied by the operator selected by the customer.
The Customer, prior to the conclusion of the purchase contract, examines the features of the goods that are described in the individual product data sheets at the time of selection by the customer.

Prior to the conclusion of the purchase contract and before the confirmation of the order with "payment obligation", the customer is informed regarding:

• Total price of the goods inclusive of taxes, with details of postage and any other costs;
• Mode of payment;
• The period within which the seller agrees to deliver the goods;
• Terms, conditions and procedures for exercising the right of withdrawal;
• The existence of the legal guarantee for goods purchased;

Features of products and their availability in different geographical areas

Products are sold with the characteristics described on the Site and in accordance with the terms and conditions of sale posted on the Site at the time of the order by the Customer, to the exclusion of any other term or condition. The Seller reserves the right to change these terms and conditions of sale at any time at its sole discretion, without providing prior notice to Users of the Site. Any changes will be effective from the date of publishing on the website and will apply only to sales concluded on or after that date.

Prices, products for sale on the Site and their characteristics, are subject to change without notice. Before sending the purchase order, the customer is asked to verify the final sale price. Site users can access all over the world, and the Site may contain references to products that are not available or can not be purchased in the country of the visitor to the Site. The Products purchased on the Site are available only to users who, in the section of the website dedicated specifically, require the delivery in one of the countries that are listed on the site.

Completion of contract

The offers on www.silvanosasetti.it are not binding on the Seller and do not constitute an offer to the public, but simple ‘invitatio ad offerendum’. The order of the customer has the value of a binding contract. The order is accepted by the Seller with a receipt sent via e-mail, which contains a list of the conditions of sale, a description of the product features, the essential elements of the contract (price, mode of payment). The contract is concluded and becomes binding when the customer receives the order receipt. The order and the receipt of the Order shall be deemed to be received when the parties to whom they are addressed are able to access electronic messages. In the event that the customer does not receive an e-mail within 2 business days after posting the receipt of the Order by the Seller or any other communication, the customer is required to contact the seller via the address: info@silvanosasetti.it

Purchase of Products

The Products displayed on the Website are purchased by selecting them and by inserting them into the cart.
Once the Client has selected the Products and wants to purchase those placed in the cart, the customer will be asked to provide the data required in order to allow the completion of the Contract. In particular, the Customer will be required to provide their personal details: e-mail address, address for the delivery of the Products, billing address, tax code/ fiscal code and a telephone number where the customer can be contacted in order to inform him of the possible date of delivery of the Products. If the customer opts for the mode of payment by credit card, he will be required to communicate the details of the credit card via secure connection. For accounting and administrative purposes the Seller reserves the right to verify the details given by the customer. In case of payment by credit card, the purchase amount will be charged to the customer after the order is completed on the site. The Customer may pay for the Products ordered through one of the payment methods indicated on the Website.
Under art. 51 of the Consumer Code, we inform the customer that the order entails the obligation to pay.

3. Delivery of goods

Shipping

The Seller ships via courier (DHL, UPS, EXECUTIVE). As required by the rules of the trade, shipments are accompanied by official invoice stating the value of the individual items in Euro.

Date of Delivery

The Sellers guarantee to do everything in their power in order to respect the delivery times indicated on the Site and, in any case, to deliver within a maximum of thirty (30) days from the day following the date on which the customer has sent the order and after confirmation of payment.
In case of non-execution of the order by the Seller, due to the temporary unavailability of the Product, the Seller shall provide written notice to the customer and will refund any amount already paid by the customer for the payment of the Product according to the following paragraph.

The website indicates the availability or unavailability of the Products, if a product ordered by a customer is not available for delivery despite the confirmation of the order, and confirmation of payment , the Customer will be promptly refunded.

Orders are shipped by the Seller from Monday to Friday from 9:00 - 16:00 hours. Orders placed during the weekend will be processed on the following Monday morning.

Unless otherwise specified in the order the delivery of the purchased products occurs within an average 5 working days for orders from Italy and within 10 working days for all other destinations.

The products will be delivered in any case within 30 days under the terms of the law.

It is possible to ship goods to Italy, to the European Community and to countries outside the European Community.

The shipment of the Products ordered by the Consumer will be in the mode selected by the Customer, among those available, and indicated on the Site at the time of the order. The Customer agrees to check without delay, and in any event not later than three (3) days from receipt of the Products, the correctness of the delivery and the inclusion of all and only the Products purchased within that period, and to inform the Seller of any defective Products received or the differences from the order placed. If the package or the packages of products ordered by the customer reach their destination in a visibly damaged condition, the customer is asked to refuse the delivery by the shipping agent or to sign a "Goods unchecked" delivery.

Once the deadline referred to in the preceding paragraph is reached, without the customer having made claims against the shipping agent, the Products delivered shall be deemed finally accepted by the Client.

Please note: If for any reason, an order from silvanosassetti.it is not successfully delivered to the Customer’s address due to a lack of cooperation from the client (wrong telephone number, wrong address, absent at address, non-compliance with import regulations) as per the commercial agreement, the package risks being sent back to Italy at the Customer’s expense including any import fees that may be assessed. These fees will be deducted from any eventual reimbursement.

Payment

The payment of the price of products purchased through the Website shall be made within the deadline of 72 hours from the date of transmission of the order confirmation by the Seller to the Customer. The Customer expressly agrees that the execution of the Contract by the Seller shall start at the date the money transfer is received on the Seller’s bank account.
The Seller accepts payment by Credit Card and Paypal. In the latter case, the customer must send copy of the transfer order with indication of the transfer number to the address info@silvanosassetti.it

Prices shown on the Site are in Euros and are inclusive of VAT unless you have selected an alternative country where VAT is not chargeable.

Customers purchasing from an Extra-Cee country will be charged for the items purchased (VAT excluded) and shipping costs only.

Please note that orders shipped outside of the European Community are served as DDU (Delivered Duty Unpaid) and may be subject to tax and customs duties.
We recommend you contact your local customs authority to determine a landed cost price prior to purchase completion.
Please be aware that some shipments may experience delays due to the customs clearance process, which are outside of our control.

- Credit Cards
It is possble to pay using the following credit cards: Visa, Mastercard, Maestro, American Express, Diners.

- PayPal
The customer is given the option to pay for purchases by using a Verified Paypal account.
The Seller accepts payments from verified accounts and reserves the right to ship the goods to the address of the account verified by PayPal.
Payments from verified PayPal accounts can NOT be canceled.

Guarantee

Under the European Directive 44/99/EC and the Italian Legislative Decree n. 206/2005 (Consumer Code) and the rules and regulations referred to in Articles 128, 129, 130, 131, 132, 133, 134, 135 and subsequent amendments to the Decree. 206/2005, under which the Seller guarantees to the Customer, who qualifies as a “Consumer”, that the Products will be free from defects in design and material and conform to the descriptions posted on the Site. The application of any guarantee does not apply in case the use or the cleaning of the product does not comply with the instructions and warnings provided by the Seller and/or in the description on the tags or labels.

The Customer will examine the products in the shortest possible time and will send to the Seller, by e-mail or registered mail, an explicit complaint with an indication of the defect and/or non-compliances identified, and the relevant documentation as indicated in the return form (at least one photograph of the product, the order confirmation sent by the Seller and the receipt).
Following the receipt of the form and accompanying documentation, the Seller will assess the defects or non-compliance reported by the customer and, after making quality checks to verify the non-conformity of the Product, will, at their discretion, decide whether to authorize the return of the Product by the Customer, contacting the Customer via e-mail at the address provided by the latter during the process of registration on the Site.
Authorization to return the Products shall not constitute in any way recognition of defects or non-compliance, existence of which will be confirmed after the return.

The Products for which the Seller has authorized the refund will be sent by the Client, together with a copy of the return authorization within 30 (thirty) days of notification of the defect or non-conformity to the following address:

If the Seller is required to refund the Customer the price paid, the refund will be made through Pay Pal.

Product Liability

The provisions laid down in Directive 85/374 / EEC regarding damage caused by the product, apply. The Seller, as the distributor, is freed from responsibility by indicating the name of the manufacturer.

Returns and Right of Withdrawal

The Customer, who qualifies as a “Consumer”, has the right to withdraw from the contract without giving any reason, within 14 days from the date the Customer (or a third party appointed by him) has received the product or, in the case of multiple products delivered separately with a single order, has received the final product.

Customers wishing to exercise the right of withdrawal must notify the Seller by written declaration, which can be sent via email to customercare@silvanosassetti.it

All the costs of returning the order are responsibility of the customer (shipping, taxes and duties).
We are unable to specify the amount of the Customs duties and of the import taxes because they are calculated directly by the Italian Customs and the costs vary by product category, price and material.

Within 14 days of the notification of withdrawal, the customer must return the product to the Seller in accordance with the terms and conditions laid down in this Article.

In case of withdrawal, the Customer will be refunded the payment without undue delay and, in any case, in not more than 14 days. Such refunds will be made using the same method of payment used for the initial transaction, except if the customer requests the refund with another means of payment. In this case, he will be charged for any additional costs resulting from the different means of payment chosen. The refund may be suspended until receipt of the Product, or until the Customer can prove having sent back the goods, whichever occurs first.

Note: Customers who purchase with a VAT registration number cannot exercise the right of withdrawal.

- Terms of Withdrawal
The withdrawal is subject to the following conditions:

• The product must be returned to the Seller, undamaged, not used, washed, stained or damaged and must be returned in original packaging, complete in all its parts (including packaging and any documentation and accessories). To limit damage to the original package, we recommend, to put it in another box on which the address of the Seller will be written.
• The product must be returned to the Seller with all the original labels and identification tags affixed to it.
• The attachment of labels or tape directly on the original packaging of the product should be avoided in all cases.

The Seller reserves the right to verify full compliance with the above conditions and goods which do not comply with the above conditions will not be accepted or refunded.

Force Majeure

The Seller shall not be liable in the event of a total or partial default of its obligations arising from any contracts concluded under the present general conditions of sale, if such failure is caused by unpredictable events and/or natural events beyond its reasonable control, including, without limitation but not limited to, catastrophic natural events, acts of terrorism, war, riots, lack of electricity, the general strike of workers in public and/or private, strike and / or restrictions on the viability of couriers and air links.

Governing Law and Jurisdiction

Any contract of sale concluded between the Seller and the Customer in accordance with these general conditions of sale shall be governed by, and construed in accordance with, Italian laws. In any case, they will be granted without prejudice to any further rights granted to Customer by mandatory provisions of law in force in the State of residence of the latter.
Any disputes will be settled by the Court in Fermo, except in cases where such provision are not applicable due to the mandatory rules of law in force in the country of residence of the customer.

Validity of Clauses

The headings of the terms used here are purely indicative and have no effect on the identification of the contents and interpretation of this contract.
These General Conditions of Sale shall not affect the rights conferred by Italian law to the Consumer.
In the event that any provision, or part of any provision, of these terms and conditions, should be held to be invalid because it is inconsistent or contrary to the rule of law, all other provisions of this Agreement, or parts of the same provision, shall remain in full force and effect.

5. Final Provisions

The Customer acknowledges that he or she has not been induced to accede to this contract by prior oral statements.
If any of these Terms and Conditions should be invalid or become invalid at a later date, this does not affect the validity of the remainder of this contract. In this case, the invalid clause is replaced with a term that represents it as closely as possible in intent and economic purposes or with the appropriate legal provisions. The Seller reserves the right to amend these terms and conditions at any time. The amended general terms and conditions are made available on the website www.silvanosassetti.it

L’accesso e l’utilizzo del sito di e-commerce www.silvanosassetti.it (d’ora in poi denominato “Sito”), così come l’acquisto di articoli del Venditore, presuppongono l’aver letto, riconosciuto ed accettato la seguente sezione di Termini e Condizioni di Vendita.
Le presenti condizioni generali di vendita si applicano ogni volta che viene effettuato un acquisto attraverso il Sito tra utenti qualificati come “Clienti” e il Venditore, e sono disciplinate dagli accordi di vendita online Parte III, Titolo III, Capo I, del Codice del Consumo, D.Lgs. n. 206/2005, modificato dal D.Lgs. n. 21/2014 e dal D.Lgs. n. 70/2003.

2 Condizioni generali di vendita

Le seguenti Condizioni Generali di Vendita regolano tutti i contratti di vendita finalizzati tra il Venditore ed i Clienti tramite il Sito.

Ogni acquisto è regolato dalle Condizioni Generali di Vendita pubblicata sul Sito aggiornato al momento dell’ordine effettuato dai Clienti.

Ai Clienti viene richiesto di prendere visione delle seguenti Condizioni Generali di Vendita e di accettarle, in particolari delle informazioni pre-contrattuali prima di procedere alla conferma dell’ordine.

All’atto dell’invio dell’ordine, i Clienti accettano le seguenti Condizioni Generali di Vendita, che verranno mostrate in fase di conferma d’ordine.

Per poter effettuare acquisti tramite il Sito, è necessario aver compiuto 18 anni.

Qualsiasi costo per la connessione al Sito, è unicamente imputabile ai Clienti a seconda dell’operatore telefonico utilizzato. Il Cliente prima del completamento dell’ordine è tenuto ad esaminare ogni informazione del prodotto che è intenzionato ad acquistare.

Prima della conclusione dell’ordine, il cliente sarà stato informato riguardo a:

Importo totale dell’articolo, inclusivo di tasse, spese di spedizione e qualsiasi altro costo;
Modalità di pagamento;
Modalità e tempistiche di consegna;
Termini, condizioni e procedure per poter esercitare il diritto di reso;
Garanzia degli articoli acquistati;
Termini dei servizi post-vendita e altre garanzie fornite dal Venditore

In qualsiasi momento prima della conclusione del contratto, i Clienti potranno accedere alle informazioni del Venditore riguardanti indirizzo, numero di telefono, indirizzo e-mail, come di seguito riportate:

Informazioni e disponibilità dei prodotti in relazione alle differenti aree geografiche

I prodotti vengono venduti secondo le caratteristiche riportate sul Sito e secondo le Condizioni Generali di Vendita presenti sul Sito al momento dell’ordine da parte dei Clienti.

Il Venditore si riserva il diritto di variare le Condizioni Generali di Vendita in ogni momento e a sua discrezione, senza l’obbligo di informare i Clienti. Qualsiasi variazione sarà effettiva dal momento della pubblicazione sul Sito.

Prezzi, prodotti e caratteristiche dei prodotti in vendita sul Sito sono soggetti a variazioni senza l’obbligo di alcuna comunicazione. Prima di inviare l’ordine, i Clienti sono tenuti a verificare il prezzo finale di vendita. I Clienti possono accedere al Sito da qualsiasi parte del mondo, l’offerta dei prodotti potrebbe variare a seconda dell’area geografica.

Regole del contratto

Le offerte proposte su www.silvanosasetti.it non sono vincolanti per il Venditore e non costituiscono un’offerta al pubblico, ma una semplice ‘invitatio ad offerendum’. L’ordine viene accettato dal Venditore solamente quando i Clienti riceveranno una conferma d’ordine via e-mail, contenente articolo, prezzo e modalità di pagamento utilizzata.

Gli articoli mostrati sul Sito sono acquistabili inserendoli nel carrello, successivamente verranno richiesti tutti i dati necessari al completamento del contratto. Nello specifico, ai Clienti verranno richiesti i seguenti dati: indirizzo e-mail, indirizzo di spedizione e fatturazione, codice fiscale, numero di telefono. Qualora i Clienti optino per il pagamento tramite carta di credito, verrà richiesto l’inserimento dei dettagli della stessa tramite una pagina protetta. Per fini fiscali ed amministrativi, il Venditore si riserva il diritto di verificare i dati forniti dai Clienti.

I Clienti possono pagare attraverso i metodi di pagamento illustrati sul Sito.

Secondo l’articolo 51 del Codice dei Consumatori, ogni ordine può essere accettato solamente a seguito del pagamento dello stesso.

Pagamento

Il pagamento del prezzo dei prodotti acquistati tramite il Sito dovrà avvenire necessariamente entro le 72 ore dalla data di invio dell’ordine. I Clienti accettano implicitamente che il Contratto diventa esecutivo dal momento in cui il pagamento viene incassato dal Venditore.

Il Venditore accetta pagamenti tramite carta di credito, PayPal e bonifico bancario. Nell’ultimo caso i Clienti sono tenuti ad inviare a customer@silvanosassetti.it una copia dell’ordine di bonifico inserito.

I prezzi mostrati sul sito sono in Euro ed inclusivi di IVA per i Clienti appartenenti alla CE, esenti IVA per quelli Extra-Ce.

Gli ordini destinati a paesi Extra-Ce, vengono spediti in condizioni DDU, i Clienti potrebbero quindi dover pagare tasse e dazi doganali che non verranno rimborsati dal Venditore.

I processi doganali potrebbero allungare i tempi di consegna dichiarati nelle Condizioni Generali di Vendita.

Garanzia

Si richiamano la Direttiva europea 44/99/CE e del Decreto legislativo italiano n. 206/2005 (Codice del consumo) e le disposizioni normative di cui agli articoli 128, 129, 130, 131, 132, 133, 134, 135 e successive modifiche del D.Lgs. 206/2005, in base alla quale il Venditore garantisce ai Clienti, qualificabile come Consumatore, che i Prodotti saranno privi di difetti di progettazione e di materiale nonché conformi alle descrizioni pubblicate sul Sito. È esclusa l’applicazione di qualsiasi garanzia in caso di utilizzo o lavaggio del Prodotto non conforme a quello proprio del Prodotto e alle istruzioni/avvertenze in merito fornite dal Venditore, ovvero riportate nella documentazione illustrativa di riferimento, nei cartellini o nelle etichette. Il Cliente avrà l’onere di esaminare i Prodotti nel più breve tempo possibile trasmettendo al Venditore, a mezzo e-mail, ovvero raccomandata a r, l’esplicita richiesta con indicazione del difetto e/o della non conformità riscontrati, nonché la relativa documentazione indicata nel modulo di reso medesimo (almeno n. 1 (una) fotografia del Prodotto, la conferma dell’ordine trasmessa dal Venditore e la ricevuta fiscale).

A seguito del ricevimento del modulo e della relativa documentazione, il Rivenditore valuterà i difetti e le non conformità denunciati dai Clienti e, dopo avere effettuato i controlli qualitativi atti a verificare l’effettiva non conformità del Prodotto, deciderà, a propria discrezione, se autorizzare la restituzione dei Prodotti fornendo ai Clienti un riscontro via posta elettronica all’indirizzo fornito da quest’ultimo nel corso del processo di registrazione al Sito. L’autorizzazione a restituire i Prodotti non costituirà in alcun modo riconoscimento di difetti o non conformità, la cui esistenza dovrà essere accertata successivamente alla restituzione. I Prodotti di cui il Venditore abbia autorizzato la restituzione dovranno essere resi dai Clienti, unitamente a copia della comunicazione di autorizzazione alla restituzione, entro 30 (trenta) giorni dalla denuncia del difetto o della non conformità, al seguente indirizzo:

3 Spedizioni

Silvanosassetti.it affida le proprie spedizioni a corrieri convenzionati DHL, UPS, EXECUTIVE dal lunedì al venerdì, dalle 9:00 alle 16:00, gli ordini ricevuti vengono processati entro il giorno lavorativo successivo, ed in seguito affidati al corriere.

Una volta affidato l’ordine al vettore, le tempistiche di consegna sono di 1-2 giorni lavorativi per l’Italia, 2-4 giorni lavorativi per il resto del mondo, salvo eccezioni.

Per la consegna della merce è necessaria la presenza del cliente o di un suo incaricato.

Qualora il pacco ricevuto dovesse risultare danneggiato o non integro, il cliente è invitato ad accettare la consegna “con riserva” e a contattare immediatamente il servizio clienti Silvanosassetti.it attraverso la mail customer@silvanosassetti.it.

Trascorsi 3 giorni dalla data della consegna, il pacco si intenderà normalmente consegnato.

Qualora la consegna venisse rifiutata, le spese di rientro verranno detratte dall’importo dell’ordine rimborsato.

Disponibilità della merce

Qualora l’articolo acquistato dal cliente non fosse più disponibile presso Silvanbosassetti.it, il cliente riceverà comunicazione scritta contestuale al rimborso totale dell’ordine.

Eventuali richieste di modifica dell’indirizzo di spedizione vanno comunicate a customer@silvanosassetti.it, e sono possibili fino all’elaborazione dell’ordine.

Resi

Gli articoli ordinati possono essere resi entro 14 giorni lavorativi dalla ricezione dell’ordine.

Il cliente è tenuto ad inviare una comunicazione scritta circa l’intenzione di rendere l’articolo a customer@silvanosassetti.it, specificando il codice dell’ordine e dell’articolo che è intenzionato a rendere, conseguentemente riceverà le istruzioni per effettuare il reso.

Il prodotto da rendere va reinserito nella confezione originale con tutte le etichette, cartigli, dustbag, ecc.. Tutta la merce restituita è soggetta ad ispezione per verificare l’integrità del prodotto. Silvanosassetti.it accetterà esclusivamente articoli resi nelle stesse condizioni in cui sono stati spediti. Le spese di rientro del reso sono a carico del cliente.

Una volta verificata l’integrità del prodotto, verrà avviato il processo di rimborso che può richiedere fino a 7 giorni lavorativi.

Qualora il prodotto non dovesse risultare danneggiato il rimborso verrà effettuato tramite lo stesso metodo di pagamento utilizzato in fase d’ordine, in caso di bonifico bancario, il cliente è tenuto a comunicare in fase di richiesta di reso anche le coordinate bancarie su cui riaccreditare l’importo.

Qualora il cliente avesse ricevuto un articolo differente da quello ordinato, è tenuto a contattare tempestivamente customer@silvanosassetti.it segnalando l’anomalia riscontrata, dopo le opportune verifiche Silvanosassetti.it provvederà al rientro e sostituzione/rimborso dello stesso.
Responsabilità da prodotto

Valgono le disposizioni di cui alla direttiva 85/374/CEE per quanto attiene ai danni provocati dal prodotto. Il Rivenditore, quale distributore, si libera da responsabilità indicando il nome del produttore.

Diritto di recesso

- ai sensi dell’art. 49, comma 4, - Diritto di recesso

I Clienti, qualificabili come Consumatore, hanno il diritto di recedere dal contratto, senza indicarne le ragioni, entro 14 giorni da quando il Consumatore o un terzo da lui incaricato ha ricevuto il Prodotto o nel caso di acquisto di più prodotti consegnati separatamente con un solo ordine, ha ricevuto l’ultimo prodotto. Il Consumatore che intende esercitare il diritto di recesso dovrà comunicarlo al Venditore tramite dichiarazione scritta esplicita, che potrà essere trasmessa a mezzo raccomandata a r., o tramite posta elettronica all’indirizzo customer@silvanosassetti.it.

Entro i 14 giorni successivi alla comunicazione del recesso, il Consumatore dovrà restituire il Prodotto al Venditore secondo le modalità e le condizioni previste nel presente articolo. In caso di recesso, saranno rimborsati i pagamenti che il Consumatore ha effettuato, comprensivi dei costi di consegna (ad eccezione dei costi supplementari derivanti dalla Sua eventuale scelta di un tipo di consegna diverso dal tipo meno costoso di consegna standard offerta), senza indebito ritardo e, in ogni caso, non oltre 14 giorni. Detti rimborsi saranno effettuati utilizzando lo stesso mezzo di pagamento usato per la transazione iniziale, salvo che il Consumatore non richieda il rimborso su diverso mezzo di pagamento, in tale caso saranno a carico del Consumatore eventuali costi aggiuntivi derivanti dal diverso mezzo di pagamento scelto dal Consumatore stesso. Il rimborso può essere sospeso fino al ricevimento del Prodotto oppure fino all’avvenuta dimostrazione da parte del Consumatore di aver rispedito i beni, se precedente.

Nota Bene: Non possono esercitare il diritto di recesso i clienti che acquistano con Partita IVA.

Il recesso è comunque sottoposto alle seguenti condizioni:

- il Prodotto dovrà essere restituito al Venditore, integro, non utilizzato, lavato, macchiato o danneggiato e dovrà essere restituito nella confezione originale, completa in tutte le sue parti (comprese imballo ed eventuale documentazione e dotazione accessoria); per limitare danneggiamenti alla confezione originale, raccomandiamo, quando possibile, di inserirla in una seconda scatola, sulla quale annotare l'indirizzo del Venditore;

- il Prodotto deve essere restituito al Venditore con tutte le etichette e i cartellini identificativi originali apposti ad esso;

- va evitata in tutti i casi l’apposizione di etichette o nastri adesivi direttamente sulla confezione originale del Prodotto.

Il Venditore si riserva di verificare il pieno rispetto delle condizioni sopra indicate e le restituzioni non conformi alle condizioni sopra indicate non potranno essere accettate o rimborsate.

Legislazione applicabile e foro competente

Ogni contratto di vendita concluso tra il Venditore e i Clienti ai sensi delle presenti condizioni generali di vendita sarà disciplinato ed interpretato in conformità alle leggi italiane. In ogni caso, saranno fatti salvi i diritti eventualmente attribuiti ai Clienti da disposizioni inderogabili di legge vigenti nello Stato di questi ultimi. Per qualsiasi controversia sarà esclusivamente competente il Tribunale di Fermo, salvo il caso in cui tale previsione non trovi applicazione a causa di norme di legge inderogabili vigenti nel paese di residenza del Cliente.

Validità delle clausole

Le presenti condizioni generali di vendita non pregiudicano i diritti attribuiti dalla legge italiana al Consumatore. Nel caso in cui una clausola o una parte di una clausola delle presenti condizioni generali dovesse essere ritenuta invalida perché in contrasto o contraria ad una norma di legge, tutte le altre clausole del presente accordo o parti della medesima clausola rimarranno pienamente validi ed efficaci.

5 Disposizioni conclusive

Il Cliente dichiara di non essere stato indotto ad aderire al presente contratto da dichiarazioni orali precedenti.

Se uno qualsiasi dei presenti termini e condizioni generali si dimostrasse invalido o divenisse invalido in data successiva, ciò non influisce sulla validità del resto del presente contratto. In tal caso, il termine invalido viene sostituito con un termine che rappresenta il più fedelmente possibile il suo intento e scopo economico o con le appropriate disposizioni legali. Il Venditore si riserva il diritto di emendare i presenti termini e condizioni generali in qualsiasi momento.
